Realtime is a software application and service owned and operated by Realtime, Inc, a Delaware corporation (“Realtime”). We invite you to use our software and service free of charge. By creating a Realtime account (“Service”), you agree to be bound to these Terms. In addition to these Terms, please review the Realtime Privacy Policy, which is incorporated into these Terms.
Offer and Acceptance of these Terms. Realtime is offering the limited use of its services and software free of charge on condition that you, the user, accept these Terms in their entirety. By accessing the software and service, you are agreeing to these Terms and you consent to having these Terms delivered to you in electronic format. To withdraw your acceptance of these Terms or your consent of Realtime acting in accordance with these terms, simply terminate your use of the Realtime software and/or service. Failure to comply with these terms can result in the termination of your Realtime account at the sole discretion of the Realtime accountability and standards team. These terms may be updated at any time and the most recent version of these terms will appear on the Realtime website.
Eligibility. No one under the age of 16 may use the Realtime services. By using Realtime, you are hereby affirming that you are of sound mind, can legally form a binding contract, are not barred from using social media services by some government entity of proper jurisdiction, and that you will comply with the Terms and all other applicable laws.
Nature of the Service. When you set out to share your location, Realtime provides that location in real-time, to either the entire universe of Realtime users or the select Realtime users that you specify. In addition, Realtime grants communication capabilities between you and either the entire universe of Realtime users or the select number of Realtime users that you specify. As a default, your location and communication will only be shared with the select users that you specify.
Use of the Application and Service. Realtime hereby grants you a limited, non-exclusive license to use the Realtime service and software. This can be done for personal, non-commercial use only. This license is non-transferable and non-assignable. In order to use the service, you must register an account on the Realtime service. At your election, you may link your Realtime account to another third-party social media account. In so doing, you hereby authorize Realtime to access certain biographical information contained in said third-party service, such as name, age, profile picture, gender, etc. At all times Realtime will ensure that it or the third-party service notifies you of all information you are granting access to. Further, Realtime will never post any information to any third-party service without your expressed consent in advance.
Account Security. As your Realtime account will have access to the biographical information stated above, anyone with your username and password can access said information. You are responsible for maintaining the confidentiality of the username and password that you designate and amy update from time to time. Further, you are responsible for any activity undertaken by persons other than yourself, using your account with your permission. If you learn that someone has accessed you account without your permission, you agree to notify Realtime of that security breach.
Privacy. Realtime values the Privacy of all of its users. A complete Privacy Policy can be accessed on the Realtime website. By using the Realtime service, you agree that Realtime can collect, store, and use your information in accordance with the Privacy Policy.
Duty Use Service in Good Faith. You may not use Realtime to harass, intimidate, bully, or violate the intellectual property laws of others. Further you must respect the privacy of others as outlined in the Privacy Policy. You may not use Realtime for solicitation, unauthorized marketing or spamming, or defaming others. As to the rights of Realtime, you may not use any of Realtime’s logos or branding or any other intellectual property without Realtime’s expressed consent. Further, you may not use Realtime’s services in any commercial way which is not auhorized by Realtime.
When interacting with others, you and you alone are responsible for your interactions. Realtime does not take any preventative measures to ensure that new users are verified as authentic and absent the deletion of certain accounts that violate these terms, Realtime does not do any quality control with respect to users. You are responsible for who you communicate with, both inside and outside the Realtime environment. You are also responsible for the content of those communications. Realtime is not responsible for the conduct of any user.
Realtime is a mobile based application. You are responsible for any mobile carrier or data charges that use of Realtime results in. Please consult your service provider to ensure that Realtime data usage is appropriate for your given carrier account.
Account Deletion. Realtime may delete your account for various reasons, including but not limited to: creating multiple accounts, using your account for nefarious purposes, transferring ownership of your account, creating third-party services or applications that interact with your account without the expressed consent of Realtime, using unauthorized third-party services or software to access your account.
Disclaimers. Realtime provides this service and software “as is” and “as available”. Realtime grants no warranties as to the service or software in any way or of any kind. Software and services may contain errors or omissions that result in damages sustained. You hereby waive Realtime of all liability that may result in said negligence and will hold Realtime in no way responsible for said damages, whether they result in negligence or intentional conduct.
Miscellaneous. These terms shall be construed and governed in accordance with the laws of the State of Delaware in the United States of America. The terms of this agreement constitute the entire agreement between the parties, and the parties represent that there are no collateral agreements or agreements not otherwise provided for within the terms of this agreement. Any provision of this agreement is held to be invalid or unenforceable, all the remaining provisions shall nevertheless continue in full force and effect.
